Snap n' Sell Terms of Service

1. Acceptance

By downloading, installing, or using Snap n' Sell (the "App"), you agree to these Terms of Service ("Terms") and to our Privacy Policy. If you do not agree, do not use the App.

These Terms form a contract between you and Austin Hunt ("we", "us"), the developer of Snap n' Sell. They sit on top of, and do not replace, Apple's standard End User License Agreement, which also applies to you as an App Store user.

2. What the App does

Snap n' Sell lets you photograph an item, sends the photo to Google's Gemini model for analysis, and generates a draft marketplace listing (title, description, suggested price, condition, etc.). You can edit the draft, save it locally, and copy or share its contents to apps like Facebook Marketplace or eBay. We do not list items for sale on your behalf, and we do not handle any sales transactions between you and a buyer.

3. Accounts

You need to sign in (with Apple or Google) to use the App. You are responsible for keeping your sign-in credentials secure. Use a strong password and enable two-factor authentication on the underlying Apple or Google account.

You can delete your account from inside the App at any time (Me tab → Delete Account). Deletion is immediate and irreversible.

4. Subscriptions and billing

Snap n' Sell offers a free tier with a small daily generation limit, plus three optional auto-renewing monthly subscriptions ("Plus", "Pro", "Max") that raise that limit:

• Free — 3 listings per day
• Plus — 10 listings per day
• Pro — 15 listings per day
• Max — 25 listings per day

Subscription prices, durations, and renewal terms are shown inside the App before you purchase, and on the App Store listing.

How billing works

• Subscriptions are sold by Apple via the App Store. Payment is charged to your Apple ID at confirmation of purchase.
• Subscriptions auto-renew at the end of each billing period unless canceled at least 24 hours before the period ends.
• Your Apple ID is charged for renewal within 24 hours prior to the end of the current period.
• You can manage and cancel your subscription in iOS Settings → your Apple ID → Subscriptions. Deleting the App does not cancel an active subscription.
• Refund requests are handled by Apple via reportaproblem.apple.com, subject to Apple's policies. We cannot directly issue refunds.

5. Acceptable use

You may use the App only for lawful purposes. You agree not to:

• Generate listings for items whose sale is prohibited by law, by the marketplace you plan to list on, or by your local jurisdiction (e.g. stolen goods, weapons, controlled substances).
• Submit photos that contain illegal, abusive, hateful, sexually explicit, or otherwise inappropriate content. Google's Gemini safety filters may also block such inputs.
• Reverse-engineer, decompile, or attempt to extract the source code of the App.
• Attempt to bypass or tamper with the App's daily generation limit, subscription enforcement, abuse prevention, or analytics.
• Use the App to send automated, mass, or scripted requests to Google's Gemini models via our infrastructure.
• Resell, sublicense, or distribute the App or AI-generated outputs in a way that competes with Snap n' Sell.

We may suspend or terminate your access without notice if we reasonably believe you are violating these rules.

6. AI-generated content

Listings generated by the App are produced by Google's Gemini model based on your photo and your optional context. They are suggestions, not guarantees of accuracy.

• You are responsible for reviewing every generated listing for accuracy before publishing it to a marketplace.
• Suggested prices and product details may be wrong, outdated, or inappropriate for your specific item, region, or buyer pool.
• You are solely responsible for the accuracy of any listing you publish elsewhere, and for compliance with the rules of whichever marketplace you publish to.

To the extent we have any rights in generated outputs, you are free to use them in your own listings without further license from us.

7. Intellectual property

The App, including its name, logo, source code, designs, and other branding, is owned by Austin Hunt and protected by copyright and other laws. You receive a limited, personal, non-transferable license to use the App for its intended purpose.

You retain ownership of the photos you submit and any listings derived from them. You grant us a limited license to transmit your photo to Google's Gemini service for the sole purpose of generating your listing, and to store the resulting listing locally on your device and on our backend per the Privacy Policy.

8. Third-party services

The App relies on third-party services including Apple (App Store, Sign in with Apple, StoreKit, App Attest), Google (Sign-In, Firebase Authentication, Firestore, Vertex AI / Gemini, App Check). Your use of those services is also subject to their own terms and privacy policies. We are not responsible for failures, outages, or policy changes by those services.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or secure, that AI-generated listings will be accurate or profitable, or that listings published to third-party marketplaces will succeed in any sale.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM (A) YOUR USE OR INABILITY TO USE THE APP, (B) ANY AI-GENERATED CONTENT, OR (C) ANY UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR DATA.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE APP IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR SUBSCRIPTIONS IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $20.

11. Termination

You can stop using the App at any time by deleting it and, if applicable, canceling your subscription in iOS Settings. We may suspend or terminate your access for violation of these Terms, for abusive use of our infrastructure, or if continued operation becomes impractical for us. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, governing law) will survive.

12. Changes to these Terms

We may update these Terms from time to time. If we make a material change, we will update the "Last updated" date at the top and, where reasonable, notify you in-app or by email. Continued use of the App after a change means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of the State of South Carolina, United States, without regard to its conflicts-of-law principles. Disputes will be resolved in the state or federal courts located in South Carolina, unless required otherwise by applicable consumer-protection law in your jurisdiction.
